Texting people who didn't ask for it can break U.S. law (a rule called the TCPA) and bring real fines. Phone carriers also block senders who do it. A clear yes up front keeps you safe and gets your texts to people who actually want them.
How to Get Consent Before Texting Your Leads
How to Get Consent Before Texting Your Leads
You can text your real estate leads on SiteStakes, but U.S. law says you need their permission first. Here's what that means and how to do it right. (Plain-English overview, not legal advice.)
Why do you need consent?
What does good consent look like?
A clear, on-purpose yes. The lead checks a box themselves — not one that's pre-checked. You tell them who you are, that message and data rates may apply, and roughly how often you'll text. And you tell them they can reply STOP to quit. Keep a record of when they agreed, in case anyone ever asks.
This is the default consent on SiteStakes:

How do you handle it on SiteStakes?
SiteStakes gives you everything you need to text leads the right way. Three things cover you:
- Collect consent on your forms. Add an SMS consent checkbox so leads opt in when they submit. See Adding SMS Consent Fields.
- Honor opt-outs. Leads reply STOP and SiteStakes stops texting them right away. See Understanding STOP/START.
- Text at fair times. Set quiet hours so messages don't go out late at night. See SMS setup and credits.
Common questions
A lead gave me their number. Isn't that consent?+
Not for marketing or follow-up texts. Sharing a number for one thing isn't the same as agreeing to get texts. Get a clear opt-in first.
Does SiteStakes make me compliant?+
It gives you the tools — consent checkboxes, STOP handling, and quiet hours — but compliance is your responsibility. Check with a lawyer if you're unsure.
What if I ignore opt-outs?+
You risk fines and getting your number blocked, which stops all your texts. Always honor STOP.
